Terms of Use

2.1 Eligibility

You must be at least 18 years of age to create an account independently. If under 18, you may only use the Services with parental consent and supervision.

2.2 Account Creation

To access telemedicine or health records, you must register with accurate information (identity, contact details, health info).

2.3 Accuracy & Security

You agree to keep your information accurate. You are responsible for maintaining the confidentiality of your login credentials. Notify legal@digidocta.com immediately of unauthorized access.

2.5 Multiple Accounts

You may not create multiple accounts to circumvent restrictions or billing rules.

3.1 Telemedicine and Virtual Consultations

Connect with licensed healthcare professionals for consultations, follow-ups, prescriptions, referrals, and related digital health services.

3.2 Electronic Health Records (EHR)

Store, access, and manage health records, diagnostic reports, and treatment history.

3.3 Health Information and Education

We provide informational content only. This does not constitute medical advice.

3.4 Payments and Billing

Certain Services require payment. We use third-party payment processors. You agree to pay all applicable fees.

4.1 Not a Substitute for In-Person Care

The Services complement, but do not replace, in-person medical care.

4.2 Professional Responsibility

Healthcare providers using the platform are responsible for their own care and must comply with Nigerian regulations.

4.3 No Diagnosis Guarantee

Digidocta does not guarantee a specific diagnosis, cure, or medical outcome.

You agree not to:

• Use the Services for unlawful, fraudulent, or harmful purposes.
• Interfere with or gain unauthorized access to App or server systems.
• Upload malicious code or viruses.
• Harass, threaten, or abuse healthcare providers or staff.
• Misrepresent your identity, age, or health status.
• Provide medical advice unless you are a licensed professional authorized to do so.

We may suspend access if these Terms or applicable laws (NDPA, NITDA) are violated.

Your data is processed per our Privacy Policy, aligned with the Nigeria Data Protection Act (NDPA) 2023 and NITDA provisions.

• Consent: Explicit consent is required for sensitive health data.
• Security: We implement appropriate technical safeguards.
• Rights: You have rights to access, rectification, erasure, etc. (Section 33, NDPA).
• Third-Party Processors: We use compliant DPAs (Section 27, NDPA).

All content, software, trademarks, and logos are owned by Digidocta. You are granted a limited, non-exclusive, revocable license to use the Services for personal/authorized purposes. You may not copy, modify, reverse-engineer, or distribute the Services.

If you upload content (e.g., reports), you grant Digidocta a license to store/process it solely for providing the Services.

Prices are disclosed before purchase. Payments are processed via third-party gateways.

• Refunds: Subject to our published refund policy. Requests must be made within the specified window.
• Taxes: You are responsible for applicable taxes and levies.
• Billing Disputes: Contact billing@digidocta.com.

The App may link to third-party platforms (labs, insurers, etc.). Digidocta is not responsible for third-party availability, accuracy, or practices. Review their policies before sharing data.

Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted access or specific medical results.

We are not liable for indirect, incidental, or consequential damages (including loss of profits or medical decisions). Nothing excludes liability for death, personal injury, fraud, or liability that cannot be excluded under Nigerian law.

You agree to indemnify Digidocta against claims arising from (a) your breach of Terms, (b) violation of laws, (c) misuse of Services, (d) inaccurate info, or (e) harm caused by failure to follow medical advice.

By You: You may terminate via app settings or email legal@digidocta.com.

By Us: We may suspend/terminate for violation of Terms or law.

Effect: Access ends immediately. Data retention follows NDPA/NITDA guidelines. Sections on privacy, IP, disclaimers, and liability survive termination.

We may update Terms to reflect changes in law or business. Material changes will be communicated via in-app notification, email, or website updates. Continued use constitutes acceptance of updated Terms.

Law: Governed by the laws of the Federal Republic of Nigeria (including NDPA 2023, NDPC, and NITDA).

Resolution: Disputes are first resolved via amicable negotiation (30 days). If unresolved, referred to mediation. If mediation fails, submitted to the Federal High Court, Abuja (or competent court).

If any provision is invalid or unenforceable, the remaining provisions shall remain in full force and effect.

You may not assign rights without consent. Digidocta may assign rights to an affiliate or successor (e.g., merger, acquisition) with appropriate notice.

These Terms, together with the Privacy Policy, constitute the entire agreement regarding use of the Services.
